Types of Assault

Aggravated Assault

If an assault is made worse by an external factor, this is when the charge becomes aggravated assault. Common aggravated assaults include severe injury, permanent disfigurement/scaring, or it places the victim’s life in danger. As well as this, if the assault took place in the victim’s home or workplace or if a weapon was used, this would class as aggravated. 

Defences to a Charge of Assault 

The main recognised defences to a charge of assault are self-defence and provocation. 


Self-defence is available if the accused acted to protect themselves or another from the immediate threat of physical injury. Before a plea of self-defence is accepted, the court needs to be satisfied that the actions used in self-defence were proportionate, necessary and that there were no reasonable means of escape available at the time.
