Under article 8 of the European Convention on Human Rights, you have a human right to a family life and this should not be interfered with by social services or the Children’s Hearing, unless absolutely necessary. 

Social services can become involved with families for a variety of reasons. Whatever these reasons, and however well-intentioned they may be, it can often cause upset and disruption. 

If there is an ongoing investigation in your family’s life you should seek legal advice. The Social Work Department can hold a child protection case conference and place a child’s name on the child protection register. This can result in a referral of the case to the Scottish Children’s Reporter Administration who would, if the referral is upheld, invite you to attend a children’s hearing. If you have been invited to attend a hearing or have ongoing social work involvement with your children you should seek legal advice.
