Section 143 of the Road Traffic Act requires every person who uses, or causes and permits another person to use, a motor vehicle on a road or other public place to have a policy of insurance in respect of third party risks.
A conviction under this section carries an endorsement of 6 to 8 penalty points and discretionary disqualification. A fixed penalty is often offered in these cases of 6 penalty points and fine. If this is not accepted there is a potential if the matter proceeds to court the sanctions could be increased.
Under this section there is also a statutory defence of persons using vehicles in the course of their employment and also the court can decide that ‘special reasons’ exist for not endorsing the licence.
