The most serious contravention of the Road Traffic Act is Section 1 causing death by dangerous driving.
The penalties for this offence are a maximum prison sentence of fourteen years and a minimum period of two years disqualification. An individual convicted of this offence must re-sit and pass the extended test of competency to drive before he can regain his licence.
The Prosecution have to prove this offence beyond reasonable doubt. The prosecution must prove the manner of driving was dangerous and a causal link exists between the driving and the resultant death.
